It’s calculated at 80% of the after-tax value of his or her wage loss and will be calculated at the highest 39 of the last 52 weeks – however, this is subject to the state average weekly wage for the year prior to the injury, and the rate is established based on the date of injury. These benefits are paid as long as the worker is disabled and could last for the rest of their life. NOTE: Benefits reduce 5% each year beginning at the persons 65th birthday and once reduced the 50% at age 75 the benefits continue at that level until death.
Vocational Rehabilitation Benefits
The primary focus is to get an injured employee back to work as quickly as practical even if the employee still has some continuing problems. Vocational Rehabilitation Benefits does just that. It might mean the insurance company will hire an outside rehabilitation counselor to assist the employee and employer to make a new job assignment or make alterations to a job description to fit the needs of the worker. The carrier may even need to hire a rehabilitation agency to assist in finding the worker and new employer with the same pay.
